Dedicated Servers Terms And Conditions

THE FOLLOWING DEDICATED SERVERS TERMS AND CONDITIONS IS INTEGRAL PART OF THE MAIN TERMS AND CONDITIONS.

Introduction

This is “STS Host and Tech INC”  Dedicated Server Agreement that governs the terms and conditions in which the customer purchase a new Dedicated Server from “STS Host and Tech INC”. This policy gives  a summary of customer’s rights and responsibilities and asks the cuctomer to formally agree to them before going further with applying process.

The terms “we”, “us” or “our” refer to “STS Host and Tech INC”. The terms “You” and “Your” and “he” and “she” refer to You as the customer of
“STS Host and Tech INC” Services, or any agent, employee, servant or person authorized to act on Your behalf.

PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY BEFORE USING THE SITE OR SIGNING UP FOR ANY SERVICE THAT “STS HOST AND TECH INC” OFFERS.

Service Delivery

We will inform the client regarding the availability of the dedicated server through e-mail when the dedicated server becomes available. The invoicing regarding the use of dedicated server starts effectively on the launch date. Our company makes sure that the server is available for the client within 7 days of the payment. However, some dedicated products require more than 7 days for the delivery. To know more, you may visit the product page. If we fail to provide the client with the requested services within the 7 days, and After such deadline has expired, the customer has the complete authority to cancel the purchase order and demand for refund.

In case of renting out the dedicated server by the client to any third party, The dedicated server that rented to the Customer shall remain the property of
“STS Host and Tech INC” IP address and it will remain static for all rented servers, The Customer is the administrator of the server rented from us and The Customer is liable to install all the software and applications on the server. In case of any malfunction in the installation or non-availability of the required software only and solely the customer held responsibly. Every reasonable effort is made by us to maintain the uninterrupted operation of Your Services.
and we may not be held liable for any server malfunction following such installation.

 

Customer’s obligation

  • The Responsibility of Security and Protection

    1. You take full responsibility about choosing high secure passwords and for maintaining the security for them. You assume all the risks about the consequences resulting from the loss of such password(s).
    2. The insurance Security of your services is your full responsibility. So make sure that you are applying these steps on your product or services. Use the security tools like firewall and anti vierous etc. update the system periodically, back up your data and secure all your software.
    3. We can proceed with the immediate suspension (without notice) of any server on which would be offered paid or free public proxies, such as IRC, VPN, TOR for which “STS Host and Tech INC” has the knowledge of misuse, fraudulent or unlawful use.
    4. In order to maintain the security level of the Customer’s server, and of all its servers on its hosting platform, we agrees to notify the customer of the availability of updates for its applications where security flaws have been reported. If these application updates are not carried out at STS Host and Tech INC’s request, we reserves the right to interrupt the server’s connection to the internet network.

  • The Responsibility of your activities

          Your activities is your full responsibility so only you assume all the risks resulting from the way of using the following:

    • The products, websites hosted and services on your dedicated server.
    • The content of information transmitted, posted or collected, used, and updated.
    • All the files, including address files.
    • The shared hosting services and all contents of your web sites contents.

  • About Rights

    1. We have the right to check the Customer’s compliance with the provisions regarding use of the service. “STS Host and Tech INC” reserves the right to suspend the service without prior notice, in the event the Customer fails to comply with our terms and conditions of service and, generally, with all laws and regulations in force, as well as with rights of third parties.
    2. “STS Host and Tech INC” has right to suspend the Services (without prior notification) in accordance with the provisions set out in the Terms and Conditions, and if the Customer is in breach of any of terms and conditions, any applicable laws and regulations in force, or any applicable third party rights whatsoever.
    3. You do not have the right to request any reimbursement, replacement or compensation whatsoever from us for damages or failures to the server from the use by your staff or your members or by any other person to whom you have provided your password(s) or to any person that you give him/her the permission to access the server. You are fully responsible of the rented server. It is therefore your responsibility to take all the required actions and procedures to insure the server.

  • The customer shall agrees and acknowledges to

    • He is a subject to the laws applicable in the territory on which the equipment are installed.
    • “STS Host and Tech INC” has the right to suspend his service if it is used for a prohibited activity at the place of physical location of the equipment provided by us.
    • You agree that the same right applies on IP addresses and the Customer acknowledges “STS Host and Tech INC” right to suspend an IP if it is used for a prohibited activity at the place of registration of the IP. So We may suspend all the IP address of the Customer registered in the same location.

  • Other Responsibilities

    •  you have to refrain from any breach or attempted breach activities (Such as port scanning, sniffing, spoofing, including the list but not limited in the section 3 of this terms and Conditions agreement.) while using the server. In such cases, you should not be entitled to the reimbursement by us of amounts already paid in.
    • You shall pay for any license or right to use, either provided by us, or with a third party, failing which, “STS Host and Tech INC” reserves the right to suspend the service without prior notice.

 

DOS and DDOS Attack protection’s Terms

We offer the customers the protection against any type of DDoS attacks including Denial of Service (DOS) or Distributed Denial of Service (DDOS).

Depending on the nature and complexity of this Protection Service, you agree that:

  • “STS Host and Tech INC” does not subject to an obligation of means.
  • We may not detected the attack by the tools in place, and that the tools developed do not prevent the operation of the Service to be interrupted.

In case of other computer attacks such as SQL injection, brute-force, security vulnerabilities’ exploitation etc, it is the sole responsibility of you to protect the server for those kind of attacks.

 

Prohibited Activities On Dedicated Servers

If one of the following (including but not limited) services or activities where found on the server, we will proceed immediate suspension (without notice) :

  1. If we found the customer is involved in any forgery, prohibited or fraudulent activity that is considered illegal in the area.
  2.  If we found any activity being carried on through the IP where the activity seems to be prohibited at the place of IP registration.
  3.  Traffic Exchange, HitLeap, Automated Browsing, Crawlers, iMarcos, AutoSurf etc.
  4. Email Spamming of any type.
  5. IRC servers.
  6.  Pirated Content / Warez / Illegal Downloads/Uploads.
  7.  IP Scanners / Port Scanning / Bruteforce Programs.
  8.  Bank Debentures / Bank Debenture Trading Programs.
  9. Virtual Currency Mining (including but not limited to bitcoin).
  10.  Lottery / Gambling Sites.
  11.  Sites promoting hacking / illegal activities.
  12.  Hosting of an abusive content (Copyright).
  13. Fraudulent / Phishing / Replica Sites.
  14.  MUDs / RPGs / PBBGs.
  15. TeamSpeak / Mumble.
  16. Crypto Mining.
  17. Public Proxies / Public VPNs / TOR Exit / Anonymizers.
  18. DDoS-prone applications or booters / flood scripts / IP spoofing.
  19. Cracking tools / illegal software key generators.
 

 

Refund Policy

None of the dedicated server modules and products fees are refundable, unless in event of failing of delivering from STS Host and tech INC as in section 1 of this terms.

 

Support

Due to the specificity of the Service, Customers are fully in charge of the management and maintenance of their VPS. However, if they need assistance or want to leave this task to our highly-qualified administrators department, they can avail of our Managed Support service available on request.

The 24-hour, 7 seven days a week Support offered by STS Host And Tech INC relates to hardware and network support only.
