Web Hosting Terms And Conditions

THE FOLLOWING WEB HOSTING TERMS AND CONDITIONS IS INTEGRAL PART OF THE MAIN TERMS AND CONDITIONS.

Introduction

This is “STS Host and Tech INC”  web hosting Agreement that governs the terms and conditions in which the customer purchase a new web hosting from “STS Host and Tech INC”. This policy gives the customer, a summary of rights and responsibilities and asks the customer to formally agree to them before going further with applying process.

The terms “we”, “us” or “our” refer to “STS Host and Tech INC”. The terms “You” and “Your” and “he” and “she” refer to You as the customer of
“STS Host and Tech INC” Services, or any agent, employee, servant or person authorized to act on Your behalf.

PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY BEFORE USING THE SITE OR SIGNING UP FOR ANY SERVICE THAT “STS HOST AND TECH INC” OFFERS.

Service Delivery

We shall inform the Customer by automatic e-mail when the web hosting services become available. Our company shall not be liable in case the e-mail not reach the customer’s email address. Invoicing shall begin on the effective date of the online launching of the Web Hosting services. The services shall become available in few minutes, rarely for some technical issues its took maximum 2 to 3 hours to deliver. In event of failing of service delivery on the time, the customer has right to cancel the purchase order and get full refund of the purchase order. Every reasonable effort is made by us to maintain the uninterrupted operation of your services.

 

Obligations And Liabilities

  • The Responsibility of Security and Protection:

    1. You take full responsibility about choosing high secure passwords and for maintaining the security for them. You assume all the risks about the consequences resulting from the loss of such password(s).
    2. The insurance Security of your services is your full responsibility. So make sure that you are applying these steps on your product or services. Use the security tools like firewall and anti vierous etc. update the system periodically, back up your data and secure all your software.
  • The Responsibility of your activities:

         Your activities is your full responsibility so only you assume all the risks resulting from the way of using the following:

    • The products, websites hosted and services on your hosting account.
    • The content of information transmitted, posted or collected, used, and updated.
    • All the files, including address files.
    • The shared hosting services and all contents of your web sites contents.
  • The customer shall agrees and acknowledges to:

    • He is a subject to the laws applicable in the territory on which the equipment are installed.
    • “STS Host and Tech INC”  has the right to suspend his service if it is used for a prohibited activity at the place of physical location of the equipment provided by us.
    • You agree that the same right applies on IP addresses and the Customer acknowledges we right to suspend an IP if it is used for a prohibited activity at the place of registration of the IP. So We may suspend all the IP address of the Customer registered in the same location.
  • The Customer with shared hosting and/or reseller account acknowledge :

    1. Not to Use over 25% of system resources, including but not limited to Memory, CPU, Disk, Network, and Bandwidth capacity, for longer than 90 seconds in any consecutive 6 hour period
    2.  Not to Execute long-running, stand-alone, unattended server-side processes, bots or daemons.
    3.  Not to run cron entries or plesk schedule with intervals of less than 15 minutes.
    4. Not to run any type of web spiders or indexers.
    5. Not to use the hosting AS backup/storage device.
    6. Not to store over 100,000 files
    7. Not to run any MySQL or MS SQL queries longer than 15 seconds.
    8. Not to store a large number of media files (audio, video, etc.)
    9. Not to send over 100 messages per hour per user and/or 300 messages per hour for a domain name. Receive a high volume of emails, by a user or domain name, in any given period of time.
    10. As Shared Hosting you are not allow to Purchase/use a Dedicated IP Address without installing an SSL Certificate.
    11. As reseller Hosting you are not allowed to Purchase/use a Dedicated IP Address without installing an SSL Certificate. Or Not assigning the IP to your customers, the customer that belong to the reseller should apply the term No 10 of this section
    12. Not to Use more than 2GB size per database.
  • Data Backup:

    • We do our own data backup for .
    • We frequently make disaster Backup for shared and reseller servers data. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups.
    • Backups are made for server restoration purposes only and belong to us.
    • It is your responsibility to maintain local copies of your web contents and information.
    •  A “Backup/Restore” feature is included with each hosting plan and you can use this tool to back up your files.
    • If loss of data occurs due to an error of us, “STS Host and Tech INC” will attempt to recover the date for no charge to the client.
    • If data loss occurs due to negligence of a client in securing their account or by an action of the client, We will attempt to recover the data from the most recent archive for a $100.00 USD.
  • About Rights:

    1. We reserves the right to undertake checks to ensure that the Services are being used by the Customer in accordance with this Contract.
    2. “STS Host and Tech INC”  has right to suspend the Services (without prior notification) in accordance with the provisions set out in the Terms and Conditions, and if the Customer is in breach of any of terms and conditions, any applicable laws and regulations in force, orany applicable third party rights whatsoever.
    3. You shall pay for any license or right to use, either provided by us, or with a third party, failing which, “STS Host and Tech INC” reserves the right to suspend the service without prior notice.

 

Outgoing Traffic Terms

NO Spam or fraudulent e-mails: We do not tolerate the transmission of these emails. We monitor all traffic to and from our web servers for indications of spamming. When we face this case we shall inform the Customer by e-mail and block the Server’s SMTP port. if the customer solve the case then customer may request unblocking of the SMTP port through send e-mail to us.

Any new e-mail identified as spam will entail a new blocking of the SMTP port by us for a longer period to be determined at our reasonable discretion.

If we block the SMTP three times because of spam or traffic violation, “STS Host And Tech INC” reserves the right to deny any new request for the unlocking of the SMTP port.

 

DOS and DDOS Attack protection’s Terms

“STS Host and tech INC” offers the customers the protection against any type of DDoS attacks including Denial of Service (DOS) or Distributed Denial of Service (DDOS).

Depending on the nature and complexity of this Protection Service, you agree that:

  • “STS Host and Tech INC” does not subject to an obligation of means.
  • We may not detected the attack by the tools in place, and that the tools developed do not prevent the operation of the Service to be interrupted.

In case of other computer attacks such as SQL injection, brute-force, security vulnerabilities’ exploitation etc, it is the sole responsibility of you to protect the server for those kind of attacks.

 

Prohibited Activities On Web Hosting

“STS Host and Tech INC” will proceed immediate suspension (without notice) if one of the following (including but not limited) services or activities found on the server :

  • IRC servers
  • Traffic Exchange, HitLeap, Automated Browsing, Crawlers, iMarcos, AutoSurf etc.
  • Pirated Content / Warez / Illegal Downloads/Uploads
  • IP Scanners / Port Scanning / Bruteforce Programs.
  • Email Spamming of any type.
  • Investment Sites (HYIP, FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme etc..).
  • Lottery / Gambling Sites.
  • MUDs / RPGs / PBBGs.
  • Sites promoting hacking / illegal activities.
  • Bank Debentures / Bank Debenture Trading Programs.
  • Fraudulent / Phishing / Replica Sites.
  • Public Proxies / Public VPNs / TOR Exit / Anonymizers.
  • TeamSpeak / Mumble.
  • Virtual Currency Mining (including but not limited to bitcoin).
  • DDoS-prone applications or booters / flood scripts / IP spoofing.
  • Open DNS resolvers / recursors.
  • Cracking tools / illegal software key generators.
  • Public Game Servers.
  • File hosting services.
  • Cardsharing (CCCam or equivalent).
  • Adult hosting websites or any related contents.
  • Making any files or links that breach third party intellectual property rights publicly available via websites hosted on their Instance.
  • P2P or file-sharing networks.
  • Hosting of an abusive content (Copyright).

“STS Host and tech INC” expressly reserves the right to review every shared account for excessive usage of CPU, disk space and other resources that may be caused by a violation of this Agreement or the Acceptable Use Policy. “STS Host and Tech INC” may, in our sole discretion, terminate access to the Services, apply additional fees, or remove or delete User Content for those accounts that are found to be in violation of “STS Host and Tech INC” ‘s terms and conditions.

 

Refund Policy

If the customer purchased these services (Shared Hosting, reseller hosting) with more than 30 days as contract period,

“STS Host And Tech INC” shall guarantee 30 DAYS money back if the customers not satisfied with the services, the refund exclude (IP address Fees, any purchased License, SSL Certificates ) even if those are included free in the package.

 

Support

Due to the specificity of the Service, Customers are fully in charge of the management and maintenance of their VPS. However, if they need assistance or want to leave this task to our highly-qualified administrators department, they can avail of our Managed Support service available on request.

The 24-hour, 7 seven days a week Support offered by STS “Host And Tech INC” relates to hardware and network support only.
